Changes to Non-Exclusive Franchise Agreements - Effective July 1, 2024

Non-Exclusive Franchise Hauling Permit 

A new Non-Exclusive Franchise Permit System was approved through a Memorandum of Understanding between the County of San Benito and the Cities of San Juan Bautista and Hollister for the establishment and administration of a non-exclusive permit system for the collection and diversion of solid waste in February of 2024.

Prior to July 1, 2024, haulers will need to apply for a hauling permit through the County of San Benito's Integrated Waste Management Division. Permittees are subject to an annual permit fee; quarterly and annual reporting; and quarterly franchise fee payments, or the hauling company will not be authorized to operate in within San Benito County. Reporting is required, regardless of whether any services were performed. 

Permittee may not engage in the collection of recyclables, organics, and solid waste collection services awarded exclusively to Recology San Benito County, which are detailed in the Exclusive Franchise Agreement and are inclusive of services within incorporated Hollister and San Juan Bautista and some portions of unincorporated County. Prior Non-Exclusive Franchise Agreement Hauler Communications

 The permit system has been in development by staff since June of 2022 and ongoing discussion and review has occurred by the Integrated Waste Management Regional Agency Local Task Force. On December 14, 2023, the Local Task Force provided direction to staff to recommended to the Cities of Hollister and San Juan Bautista and the County of San Benito to approve the MOU and code of ordinance revisions.
